SMALL DEBTS COURT. (Before Messrs, F. R. Wilshire, P.M., P. H. Throsby, T. W. Lackey and D. Clifford, Js P.) T. Ellsmore v. W. Barnsley. Claim £2 ISs 9J, balance of amount for posts and rails sold. Mr. Gale appeared for plaintiff, who said he re sided at Ci'Ois Roads, and 6old defendant 500 posts : and rails at 25s per 10D. Defendant took delivery of 2G5. and forwarded a cheque of £3 Gs 3d, but had never said lie would not take the remainder for some time after. The agreement was made between I them on the road, but nothing was said that the rails should correspond with timber purchased from Clout. It was not truo that some of it was. better than the other. Thomas Nye deposed that arrangement were: made with him to draw in tho whole of tho 500 : but he only delivered 2G5. He wsa told by: defendant not to draw tho wood if not equal to' Clout's. He did not think it was equal. Twenty-five shillings was a high price to pay ; ho could purchase first-c'ass rails morticed at £1 per hundred...
