The contest was brought by Cassius M. Scobey against the Northern Pacitic railroad Company. It was claimed I y S:obey that he set tled on the lar d in question December 15, 1884, and since that he resided upon, cultivated and improved it with the intention of entering it under the pre-emption laws of the United States.
