Lime Point Decision. [Newspaper Article] — Marin Journal — 2 November 1861

Lime Point Decision. Gilmer vs Lime Point.—We take a different view of this case from that of the Court below, These proceedings for the condemnation of land are to be regarded as those ot a special inquisition; and though taken under the Act of 1859 by the District Court or Judge, yet are to be being construed not by the general rules applicable to Courts of general jurisdiction, but as the acts of a Court which sits in this matter under a limited special statutory authority. We have held that the Act of 1859 is constitutional. The condemnation of the land can only be made in pursuance of the provisions of the statute— s the title coming to the U. S. through a compliance with its requirements.— Though the State possessed the power to dcclarc that the land should be taken for public uses upon other and different terms and codiiilions than those set out in the Act, it is enough to say that it has prescribed the particular conditions given the statute, and that these must be followed ...

miscellaneous. [Newspaper Article] — Marin Journal — 2 November 1861

miscellaneous. The fishing season, which was not promising at the beginning now appears unusually succesful. Both codfish and mackeril are biting with uncommon alacrity. With plenty of corn and fish, and cheap beef, we shall manage to worry through the coming winter verry comfortably. A new secession movement is going on in South America. The city of Buenos Ayers had seceded from the Argentine republic, and war is to determine the matter. The best thing in the world for low spirits is to have a clear consciencc and ja warm heart, Never be guilty of anything that would trouble your mind; keep your heart warm with love for every one, and you will skate through the world as smooth as over a sea of ice. The Northhamton Press says that an ambitious young lady was talking very loud and fast about her favorite auth-j thors, when a literary chap asked her; if she liked Lamb. With a look of ineffable disgust she answered her interlcutor, that she cared very litle about what she cat, compared ...

Good Pluck.—A young man from Lisbon, when about to enlist in the Waukesa Union Guards, was askedt'iif could sleep on the point of a bayonet," when he promptly replied saying, "that he could try it, as lie had often slept on a pint of whiskey, and the kind they used in Lisbon would kill further than any shooting iron Jie ever saw."
