(To tlhe Editor of the 31'Icor Times.) SRt,-In a recent report of the pro ceedings of the Road Board you made reference to the "Tooborac water mono poly." Now, Sir, if some person was to steal your property, you would not call him a monopolist, hut a thief. If from some malignant feeling he deliberately destroys your property without benefitting himself, you would probably, instead of a monopolist, call him an unmitigated scoundrel. I will state the facts andleave other to determine what terms most fitly describe him. The farms at Tooborae, you are aware, form a double line along the Kilmore road, those on the east of the road all having their boundaries formed by the M'Ivor Creek, consequently, they have a constant and independent water supply. Those on the western side of the road have no such supply, and, with out access to the creek, they would be deprived all summer of water, both for domestic use and for their cattle. The defeat of .Rosecrans is ascribed to the better tactics of the Southern commanders rather than their superiority in numbers. An address was presented to them, and Mr. Parr, (the captain), replied, thanking them for so kind a reception. It has been arranged that they shall play at Sandhurst on the 6th of January ; Ballarat, 11th; Ararat, 14th; Maryborough, 20th; Castlemaine after visiting New Zealand. The Floods have not yet subsided, al though the rain has stopped.

ITHEATHCOTE POLICE COURT. Monday, Decenmber 14th, 1868. (Before Mr. Willoby,.P.M.) Jalmes WV. Hayes was charged by the police with being illegally oa the premises belonging to a Mrs. Welsh. Tile defendant, in cross-examining Mrs. Welsh, elicited thi, fact that he has been on terms of very close intimacy with her, and she did not object to-his being in the tent, she only found fault with him for bringing a constable, whereas the con stable followed him.in, and Mrs. Welsh told the constable that that she would not give prisoner in challge: The Bench discharged him. Sabina.Fayhe Irnlesented to the Bench that her husband, Patrick Fayhe, who'was ordered by the Court to pay 7s. 6d. per week towards he maintenance, had dis. obeyed the order. Mr. Willoby said le would issue a warrant for his apprehension, and do all he could for tihe woman by compelling the man, if brought again before him, to find security for his obedience to the order.
