The nature of the charge was that Lynam purchased two allotments of land at Ward's sale-one suburban and the other a town allotment, on which he paid the deposits, and obtained a receipt. A short time afterward*, Lynam called ! at Wormald s office to pay the balance, j when Wormald asked for the receipt j previously given, and on obtaining it re- fused to give it up, stating that the wrong section was written tn the receipt. It was pleaded in support of the charge that the receipt referred to con- tained the only title to thc allotment which was correctly described, and there h.re undisputed ; and that the retention of the receipt from the complainant was therefore criminal.
