ALEXANDRA WARDEN'S COURT. (Before'Mr Warden Akehurst.) Wednesday, April 7. Ryan and others v O'Callaghan and others. Mr-'Coster for plaintiffs, Mr V. Smith for defendants. This was an adjournpd case for the production of a plan of the ground in dispute. On an applicantion dated 17th December, 1808, Ryan and party were put in possession of the " You never can tell" claim, Godfrey's Creek, on the 25t1l Felruary last. On the same day O'Callaghan and party obtained possessionof Nos. 5 to 11 inclusive, "You never can tell." On Ryan's' claim a shaft had been sunk by the original holders to a depth of 67 feet. Within a day or two of the 24th of January, Mr Vickery, mining surveyor, laid off the Working Miner's lead, under the supposition that the sinking was over 100 feet, giving each claim 00 feet along the supposed line of the lead, and this airrangement brought the pegs of O'Callaghan and party to about the centre of Ryan and party's claim, thereby depriving them of the shaft. .
