Gonzales, -while getting off at rount Vernon from an up passenger the New York and Harlem rail-1 train on road, on tho 25th of November, 1SG1, Tvas killed by a domi express train. His vidow sued tho company and ob tained a verdict for $5,000. The Court of Appeals reversed the judgment on the ground that Gonzales was guilty of contributory negligence in getting off on the west side, where thero was no platform. The case was tried over, and at the close of the plaintiffs case a motion to dismiss the complaint on the ground of contributory negligence by Gonzales was granted. The Court of Appeals held the non-suit improper, and again granted a new trial. The railroad company was characterized as guilty of gross negligence in so arran ging the time table as to have an express train thundering by a station within one minute of the stoppage of an ac commodation train, and the company was held bound to havo a inform on both sides of the road. A FIXE POINT IX LAW. John Goodman, the murderer of in old married couple, was hanged rec ent Iy, at Ottawa, Ohio. The murder, com mitted last April, was a most brutal one, and before his execution Goodman con fessed to the deed. There waa no ques tion as to the justice of the death ver dict in his case, but there arose another very fine question out of the murder, one not yet finally decided. Old Mr. and Mrs. Haywood, the couple mur dered, were a singular pair. They lived alone and did not agree very well. They lived on a small farm, and the property was owned separately, Mr. Haywood owning the land and par', of the stock, the old lady the household furniture, part of the stock, and money in bank. The manner of the murder was as follows : Goodman resolved to commit the deed for the sake of plunder.
