Cooke-In this case plaintiff, who is a farmer residing at Samaria, sued defendant, a. carpenter at Vinton; for the, sum of £3 10s, for carting bricks..: : Mr MNDonnell wes for plaintiff., Plaintiff lied beeon engaged td'oait bricks from Benalla to Simaria, and there was a verbal agreement' between the parties that the sum to be paid for ;cnitnge should be £1 13s for 1,500 bricks. When plaintiff came to Benalla for the bricks they wore not tready, and he laimmed £1 13s extra bueause he ha-l ia second journey for themrnand had no back loading. Plaintiff and his brother swore to theseefaots, and defendant then went into the box and stated to the Bench his version' cf the case.
