COURT OF CRIMINAL JURISDICTION. [Newspaper Article] — Hobart Town Gazette and Van Diemen’s Land Advertiser — 9 June 1821

COURT OF CRIMINAL JURISDICTION A Court of Criminal Jurisdiction, it is known, had   been convened by the Precept of His Excellency the Governor in Chief, and accordingly assembled at Launceston, on Tuesday the 15th day of May last; during the sittings the following cases occurred, of which, however, we are able to give a concise sum- mary only : Henry Butler waa charged with the wilful murder of one Benjamin Davis, now deceased, on Monday, the 6th day of March last, at the farm of Beamer's,   on Norfolk Plains. The evidence taken in this cafe extended to a great length. The prisoner and the de- ceased had been, it appeared, on the farm together for about a month or three weeks ; during which time it seemed to be clearly proved, that the most friendly terms had subsisted between them, nor was the slightest diflerence known to have taken place on any occassion whatever, up to tha time of the deceased man's death. The deceased had been drinking at Beamer's in ...

COURT OF CRIMINAL JURISDICTION. [Newspaper Article] — Hobart Town Gazette and Van Diemen’s Land Advertiser — 16 June 1821

COURT OF CRIMINAL JURISDICTION. The Court of Criminal Jurisdiction was assembled in the Court Room here on Tuesday morning last, and was occupied the whole of that day on the trial of Thomas Faro, William Cole, and William Harvey, charged with stealing 500 sheep, the goods of Thomas Kenton; but as the judgment of   the Court in the end was not guilty, and the other cases that were disposed of during the sittings of the Court till 12 o'clock the next day seemed in detail to be of comparatively minor importance, we have considered it unnecessary to give a particular report of the evidence, which must have prevented us from giving place to other more interesting matter.   The sittings of the Court have now closed, and the Calendar, including both the Settlements in this De- pendency, has been heavy, as under the circumstances might have been expected. No Criminal Tribunal had ever before sat in this Dependency, and from the moment that the circuit was notified...

From last received Sydney Gazettes. SUPREME COURT.—Second Term, 1821. Eagar qui tam v. Manigault. [Newspaper Article] — Hobart Town Gazette and Van Diemen’s Land Advertiser — 23 June 1821

From last received Sydney Gazettes.       SUPREME COURT.- Second Term, 1821, Eagar qui tam v. Manigault. Mr. Garling for the defendant had obtained a rule to shew cause why judgment of non pros. should not be signed in this cause, for not prosecuting agreeably to the Rules of the Court; but, upon consideration, the Court refused to hear the plaintiff, because they thought they could not entertain such an action as this, under the powers of the Charter; and so the Court had decided in a similar action of Eagar qui tam v. De Mestro in the Third Term, 1820. The actions were brought under the 2d Section of the Navigation Act, 12 Car. 2 c. 18, which enacts, that no alien shall ex- ercise the trade or occupation of a merchant or factor in the plantations, upon pain of the forfeiture of all his goods and chattels, one-third to the King, one-third to the Governor, and the other third to the informer. Mr. Justice Field said that, before the Court enter-...
