Northern Miner. WEDNESDAY, DECEMBER 15, 1875. [Newspaper Article] — The Northern Miner — 15 December 1875

WEDNESDAY, DECEMBER 15, 1875. THE melancholy accident which occurred on Wednesday evening last, resulting in two deaths, has forcibly awakened public attention to the danger of storing combus- tibles in the town, and to the urgent   necessity of limiting the quantity allowed to be kept for sale in shops within the bounds of safety. At present the law is powerless to compel the removal to the Magazine of those dangerous materials, no matter how large the quantity may be. The Act applies only to gunpowder. Mr. KING has pointed out the defect in the Act in this respect, and no doubt will take an early opportunity next session to get it amended. No blame can be attached to anyone up to this time for keeping those caps in their stores. No one sus- pected any danger as likely to arise. The only known way of exploding them was by percussion or ignition by fuse. Of   course, after the event, we are at no loss to see that percussion, sufficient to produce an explosi...

This was the same case that came before the Court before. The plaint was amended by changing No. 1 S. to No. 1 S.E.; the pleas were the same as already published.   Mr. Bowker objected that the Court had no jurisdiction, as it was not an action, suit, claim, demand, dispute, or question relating to 'mining' within the meaning of the 31st section of the Gold Fields Act of 1874. Mr. Carter submitted a written opinion from the Attorny-General, that the Court had juris- diction. Mr. Bowker objected to its producti...
