SMALL DEBTS COURT. I Walker v. Beck.—Adjourned till next Court-day* M'CausIand v. Aleock. £10, value of a horse, Mr. Williams appeared for plaintiffff. Id this ease both parties laid claim to a horse, branded A, this being the brand both parties use. Some time ago defendant wrote a letter to plaintiff, to know if he had a horse in his possession so branded, with certain marks besides. Plaintiff having a horse so branded, but not marked as described, sent it to defendant, in order to convince him that it was not his property. Defendant, however, took the horse from the messenger and claimed him as Ids. Plaintiff did not personally know his horses, but those who had charge of them for years could posi tively identify the horse as his property, he, therefore, called James Maples, who stated, on oath, that he knew the horse outside the Court, having cut, branded, and broken him in. TUESDAY. Before his Honer the Chief Justice and a general jury. MCEDEK. Henry Louis Bertrand, charged with the murder of Henry Kinder, at St. Leonards. This trial was concluded this day, and after the evi dence, Mr. Dalley, in an eloquent and argumentative ad dress, spoke for three hours on behalf of the prisoner. He referred to tlie peculiar disadvantages under which the defence had (o be made, the prejudice to be contended against, and the more than usual warmth with whieh the prosecution was conducted. The basis of the defence was the unreliability of prisoner's statements, oral and docu mentary, on the ground of his half insane and.extravagant character, the absence of witnesses who might have been called to prove what actually occurred at the time the shct was dischatged, and the existence of facts to show that prisoner took steps tending to save Kinder's life. In the'case of Jolin Dunn, charged with the murder o Samuel Nal;on before the jury was sworn his Honor in quired if prisoner *.vas defended by counsel. It was stated that Mr. Greer had appeared on his behalf at the preliminary inquiry, ami this was admitted as an impedi ment to counsel being assigned for ibe defence. His Honor s.iid he had no judicial cognizance of prisoner, but if this was Dunn who was outlawed, he did not sec why he should not be brought up for judgment at once.
