*WESTERN DISTRICTS. GOLD Roim~uiv.'- On Thursday last a roblbery was perpetrated near Avisford, under circumstances cnharac terised by the most consmnate audacity. It appeared that IMr. Miacarthur, a young gentleman employed as gold buyer by the Oriental Bank, was re tuming on horsbhack from Maitland Bar, on the Mcroo, and when about half-a-mile from Avisford, at about one o'clock p.m., overtook a man dressed in a jumper,. who at once took hold of his bridle, and present ing a double barrelled pistol at his head, desired him immediately to hand over his revolver. AN EXCITIr. :CA9C or CAPTURE. -James Sutton Elliott was senior military storekeep3r at Weedon. near Londun, ranking as lieutenant-colonel, receiving nearly £2000 a-year, and could have retired at any moment on half-pay, having served about thirty five years. He is between, fifty and sixtyyears of age. On tile 22nd May he absconded, and is charged with embezzling 10,800 dollars of the government money, leaving an aged wife but no children, and bringing away an actress named Sinclair, about twenty-five years of age. They left England in the America on the 22nd Miay, and arrived at Boston on the 5th of June, under the nane of Mr. antd Mrs. Brooks. On the 12th June, Mr. Robert W. Bowyer, special detective, was applied to by Mr. Henry Whit taker, a lawyer of the city, to take the papers and try to trace the de faulter. CATTLE BRANDS AND PROOFS OF OWNERSHIP. SWe find the following letter on this subject in the Mlelbourne Argus. (To the Editor of the Argus.) Sir-The~2ft-repeated adage, sum mutm ums suojma uisnria, was never more fully exemplified than at the late Beechworth Qearter Sessions, in a case of cattle stealing, to which I must beg to direct your attention. His Honor Mr. Justice Cope decided there was no case to go to a jury. because there was no evidence. The beast in question belonged to the prosecutor. The pro secutor; be it understood, who is a magistrate of the territory, distinctly swore to his brand; but the ruling was that the brand was no proof of owner ship. It happens rather remarkably, that a similr case occured last month in New South \'Vales, when His Honor Mr. Justice Diclkinson directed a jury to acquit two persons arraigned ot a charge of cattle stealing on exactly the same ground.
