DELL V. slHIRtE O PORTLAND. Mr. Wrizon moved for a rule nii for a nonsllt. The action was brought to re cover damages for that the defendants, by their negligence, caused the death of the husband of the plaintiff. The case was tried at Belfast, and the jury gave a vatr dict for the plainutiff. The death was caused as was alleged, through the de fendants placing some heaps of road metal on the water-table of a road, and the deceased, when riding along the road at eight came into cunt"e: with the metal. was thrown, and killel. It was sub mitted, first, that there was no evidence that the detendants had placed the heaps on the road; they might have been placed there by some contractor. It was also urged that the ascident had occurred before the Local Government Act came into force, and therefore that the present shire of Portland was not liable. II.M.S.S; BAPPHIRE. The Sapphire, which lhas come round on a cruise from Sydney to this port, is the latest addition to the squadren on the Australian station. She is comparatively a now vessel, having been launched from Devnoport dockyard in September, 1874, and this is her first commission. The Sapphire belongs to the " wooden walls" class of vessel, and although of modern build, there is nothing of the ironeold or monitor about her. Sihe has nevertheless a powerful armament on board, and if ooossion required, there can be but little doubt but that she would give a very good account of herself. Rules were made and for. warded to the hie Shire Council for approval by managers appointed by the townspeople. The Council then discovered that they were the legal managers, and that they could mnot grant the power to another. It my memory serves me right, I believe a committee of the Council was spproved to draw up rules to serve all the commons in the Shire, and appliction for the ofBee of herdsman was called for each common-for the Branx. holme common Mr. E.
