Brownless, manager of station, on oath, deposed : That the cubic contents of the dam was about 5000 yards. It backs water about 4 miles. Has a by-wash of six feet above level, which is 12 chains long and 2 chains wide, and is on north side of the creek. The is not prejudicnl to the Crown or anyone else. All the dams get water locally except in very uigii noons. ' To Mr. M'ICinney : There arc two dams below, but only one or any consequence, that of the Bendigo dam. The water to fill those has to go through tho by-wash of the middle dam. It is the interest of the station to maintain that by-wash in proper order. Mr. H. G. DAM ON ANA-BRANCH- YANKO CREEK. Mr. Jameson appeared for 10 obieetors. W. H. Brownless eavc evidence. The dam is on portions 13 15, parish Bolton-street, county Broome. The approximate cubic contents of dam is about 5000, and it backs the water np about three miles. The water is retained in the banks of the crcek. ' The dam is of great advantage to the Crown and. station, nnd is an injury to no one. The bv-wasli is 4 feet 3 inches above the bed of the creek, and is about 7 feet from top bank, is about a drain wide and 34 chains Ions. It returns the water int-i the Yanko Creek on portion 14, parish Broome. ? To Mr. Jameson : I have a bar across the by-wash. It is - not a permanent structure. The, height- of the by-wash ; is taken from this bar. DAM ON PORTION 5 (BENDIGO DAM). Mr Jameson appeared as obj-ctor on be half of Currie and M'Kinnon and others. W. II. Brownless gave similar evidence as in preceding case. Approximately has about 7000 cubic yards, backs water about 5 miles. It injures no one. The by-wash is about 6 feet 10 inch above the bed of the creek. It is about 60 feet wide. It is on the north side of the creek nnd is 16J chains long. To Mr. Jameson : I am responsible for filling out tbe application. The water does not flow from Yanko Creek into the Turn buck Creek. There is an error in tbe nppli casion. The surplus water does not return to tbe Yanko, it flows into the Yanko Creek. The water did not originally come from tho Yanko. The by-wash is a natural one but has been deepened. The water flows through the by-wash back into the creek. The distance bock into, the creek is -about two chains.
