Hamilton, with merchandize.   Passengers, Captain Dick & Ensign Birch, of the Native Bengal Infantry. On Wednesday the brig Governor Phillips, Captain Maingy, arrived from Calcutta   also, with merchandize.- Passenger, Mr. Drummond, Supercargo. SUPREME COURT. - SYDNEY. Friday, 28th February.   Underwood v.Ogburn & Warren's Executrix. This day the following Judgement of the Court was delivered by Mr. Justice Field:- " This was an action to recover the sum of £59 2s. 6d. being the price of 1 ton, 1 cwt. & 13 lbs. of sugar. It appears that Ogburn had one of Governor Macquarie's orders, for 200 acres of land; and being indebted to Warren,     with whom he resided, sold his land to the plaintiff for sugar, which would be as useful to Warren as money. Warren sent his cart to Underwood's for it. and Underwood's son   entered it in his book to both defendants, with these words:- "being payment of 200 acres of land, with the indulgences thereof." 'The   plaintiff continued to deal with Warren, and received a subsequent bill from him, without adverting to the sugar; & indeed never made any demand upon him for it in his life time. WHEREAS by a Government and General Order, of His Excellency   the Governor in Chief, bearing Date the 18th August, 1815, the Price of a Licence for retailing Spirits and Wine was fixed at Thirty Pounds per Annum. And whereas by Proclamation of His Excellency the Governor in Chief, bear- ing Date 22d February, 1817, it was pro- vided, that every Person, retailing Spirits or Wines without a Licence, should, upon Conviction before a Bench of Magisrates,     be subject to a Penalty of Thirty Pounds;   the Whole to go to the Party laying the Information.
