I r ' ' ' I - OPINION Continued irom pnjjo a. vated fields" and "fenced lands," etc., is used instead of the dis- class of or so that onlv mm lands is intended tn ho protected, towit, cultivated and fenced. Neither by the Statute of 1903, nor the amendment of 1905, or any other law of any kind or nature whatsoever, has the leigsla ture seen fit to repeal the provision of Section 152, with reference to fenced lands: so that it seems that a fair construction of all these statutes remaining in force would indicate that it was the intention of the several legislatures to leave that provisiou in tact. It is argued by counsel for the defense that Section 98 of the compiled Laws of 1897 has some beating upon the question at issue. This section was passed in 1882, nine years subsequent to the law of 1873, of which Sec. 152 is a part, and provides that "from and after the passage thereof it shall not be legal for any person or per sons in this Territory, or for any owner or owners of large s...

Projected Road for Twin Cities Considerable interest is being manifested in town over a new railroad project from here to Tu cumcari. Several prominant bus iness men here have been working on the quiet and a good sum of money can be raised toward build ing the road. By building a road from here to Tucumcari it will connect with the Dawson road which runs direct to the coal fields, and such connec tions would do moie for the town than any other one thing, because it would make this a great fuel distributing point. The road could easily be built as the country is practically level over nearly the whole route only one bad place and that is the cap rock where some good engineering work would have to be done. Every Business man in town is heartily in favor of doing his part and it would be a good plan to have a call meeting soon to deter mine what to do and how to do it. This is too good a thing to let go by so it behooves every man to get in the band wagon and work to ward pushing this ...
