Wishard, who the indictment states was a partner of Baker in other business, were jointly in- dicted yesterday by the federal grand jury on four counts for al- leged violation of the national banking- laws. The first count charges Baker with having misapplied, June 4, 1907, about $50,000 of the bank's funds to the * use and benefit of John A. Wishard. School Amendment May Not Have Been Adopted By Point of Law. ^ Austin, Texas, Nov. 10.—The question of whether or not the constitutional amendment per- mitting the levying of a 50-cent tax on the $ 100 valuation of prop- erty by a majority vote of any common school district, may have to be finally determined in the courts of the state. Schoolmen generally over the state including Prof. R. B. Cousins, state superintendent of public instruction, maintain that the proposed amendment pre- vailed at the election held last Tuesday, while the contention has been raised by a certain north Texas newspaper that the amendment failed.
