CoL Johnston has Jast called onr attention tn fact of which we were Iguwant, as we suppose most poople are. In criminal canes, the Coonty is authorized to pay only the witnesses on the part of the State, and not those for the defence, except where the defendant is acquitted. If he is convicted, the Connty docs not pay his witness fees. The only costs to he paid fur th defend ant by the Comity, is his board meaning the Sheriff for the board of the prisoner while con fined in jail. See Revised Statutes of 1863, Sec tion 323, Article 16, of Chapter 82, on page 872. Col.
