OFFICIAL. NOTICE. HAVING been informed from various sources, of the great suffering and needy condition of many of those deluded and thoughtless persons, who in violation of their plighted faith to their country, have deserted from the Pacific squadron, since the 9th day of October of this year; and who are now paying the penalty of their transgression, under the combined suffering of disease, famine and exposure to an inclement winter; and that many of said deserters, truly repenting their rash and ill-judged act of desertion, would return to their allegiance and their ships, but for the fear of the penalty which the laws might impose, I do hereby say to all such persons, who are chargeable with no other offence against the laws of the Navy than that of desertion — great as is the enormity — return immediately, to your duty, and you will have no cause to regret your confidence in my clemency and forbearance. TIIE TOWN COUNCIL We last week adverted to the position of the old and new councils, and now resume the subject, as, at the time we penned that article, the proceedings of the old council had not reached us. Our opinion in regard to the irregularity of the action and the want of jurisdiction of the old Council, is still unchanged. Indeed, subsequent reflection and reading have more strongly impressed the views there advanced, upon our mind. We believe that the principle assumed and acted on by the old council is a very dangerous one; and we therefore think it should be the object of every right-minded citizen to prevent their action from becoming valid, and to avoid the establishment of such a precedent. The old council was elected by an order of Gov. Mason, which order was based on representations and petitions of the citizens of San Francisco. They were to hold their offices from the day of election until the thirty-first day of December, 1848. They had no power to hold over until...

THE ELECTION. The election for delegates to the Provisional Government Convention, which was held in this town on Monday the 8th inst. was an animated and spirited affair. Despite the unfavorableness of the weather, it having rained quite hard in the afternoon, it was the largest vote ever polled in the District, amounting to three hundred and seventy-three votes. The result, though not personally palatable, is believed to be generally satisfactory; for, though the personal preferences of all could not be satisfied, we think we may rely upon the delegation as it is. Resolved, That whereas, inasmuch as one of the two judges of the late election declines to sign the returns of said election, upon the ground of their having been votes received at such election from a large number of non-residents of San Francisco, and against his will and declaration at the time: And whereas, the Council being convinced of the facts set forth in the petition signed by thirty of the known residents of this town, and as alleged by one of the judges, and also within the personal knowledge of some of the members of this council.
