Lascelles v Kemp and Gatehouse. This was an action of debt brought to recover the sum of £1000, being the penalty of a bond dated 7th May, 1818 ; and the condition, alleged to be broken, was contained in the following words :- " Now the condition of this obligation is such, that if " the above-named T.A.Lascelles shall well and truly " pay, or cause to be paid, unto the said A. F. Kemp " and G. Gatehouse, or to their assigns, the sum of " £850 of good and lawful money, on or before the 1st " day of April, 1819,and legal interest to be computed " from the 3d day of March last past, being for the re *demption of a certain farm, or farms, and buildings,   " situate and lying at Pitt Water, in the district of Sus- " sex, and formerly in the occupation of the said T. Tuesday, Feb. 13. Mitchell v. Walford. This was an action of debt ; and the first count declared upon a deed of assignment, dated at Nor- folk Island, 5th Feb. 1807, by which the defen- dant and several other creditors of the plaintiff assigned all their real and personal property on the Island to the plaintif; and Subjected both their   property and their persons to execution, under the process of the Court of Civil Juridiction there, as a security for the payment of the several sums at the several days set against their respective names   and seals. To this count the defendant demurred generally: and the demurrer first came on for   argument. Sitting Magistrate-~Rev. Robert Knopwood, A.M. SHIP NEWS.-This day arrived from Sydney, which port she left on the 7th inst. the ship Caroline, Captain Taylor. -Passengers, Mr. Bethune, Mr. Marr, Mr. Edgeworih, and Mrs. Jackson and son. By the Caroline's arrival we learn, that the embar- kation of the Honorable the Commissioner of Enquiry on board His Majesty's store ship Dromedary was fixed for the 8th instant. His Majesty's Colonial brig Elizabeth Henrietta arrived at Port Jackson on the 3d Instant, from Port Dalrymple, after a passage of 9 days, having on board a detachment of the 48th Regiment from that station, under the command of Lieutenant Vander Mealen.

SUPREME COURT. f]3" Erratum in our last Report.-For " 2G31bs. of j tobacco, and *781bs. of sugar," read " 201bs. of to- bacco, and 26á}bs. of sugar." Tuesday, Feb 1827 Loane v. Beamont.   This was an action for fraudulently representing John Smallman as a solvent person, whereby the plain-   tiff was induced to trust him with goods to the amount of 16 pd 4s. It appeared, that Smallman came hither as a convict by the Indefatigable, in the year 1812 Or 1813, and in the year 1816 was the defendant's Go vernment man. In June 1816, the defendant and his man entered into a verbal agreement, that the former should sell to the latter a farm of 500 acres, near Herds man's Cove, of which 35 acres were then in crop, 12   working bullocks, and certain implements of husbandry, for the sum of 14pd 1s, to be paid by three yearly instal ments; and early in the year 1817, when Smallman had been 12 months on the farm, the parties signed three agreements for leas...

Robert Knopwood, M.A.   SHIP NEWS.-On Tuesday last ar- rived from England direct, the transport ship Medway, Captain Wight, with 156 male prisoners, the complement she took on board, under the superintendance and care of Doctor Davies, of the Royal Navy. She sailed from Portsmouth the 15th of November. The Officer of the Guard, which consists of 30 non-cominissioned officers and privates of the 53d Regiment, is Lieutenant Gor don,of the 82d Regiment.-Passengers, W. Wemyss, Esq. Deputy Commissary General, and Lady, Michael Moodie, Esq. Assistant Commissary General, Mr. and Mrs. Thompson and family, and Mr. Halden. Same day arrived also from England, the ship Emerald, Captain Elliott, with a valuable cargo of merchandize. .
