The Legislature of this Territory has from its or igin assumed that it is authorized to iix the term of the supreme and district courts. or by representation. Tho declarations of the crons present, whether confined to the parties themselves or communicated to the defendant, could not effect his legal rights, unless it should appear that he in Mine way accepted or assented to them.
