Mr.:Lowe ap-' peared for plaintiff, a grazier, at Springvale,: who stated that lie had grazed defendant's horse for six months. In reply to defendant, he said he had also-a filly and a heifer of his. Had been asked to deliver them, but had not done so. Was paid for all previous stock when delivered by at him at dle fendant's residence. His reason for not delivering the filly and heifer was because it was arranged that the existing agreement,' that stock should be paid for before leaving; the paddock, should be strictly adhered to.
