Mr. _ Forbes, instructed by Mr. Thorold, for plain tiff; Mr. 'Frederick Brown,- instructed by Mr. Fleming, for defendant.' It appeared from tho evidence of: plaintiff, who is a mail, contractor, tiiat he holds about 2,840 acre.? of fenced in land at the Billabong, on which defendant's Bheep committed repeated trespasses, during which they also damaged some water tanks. The consumption of the gross by defendant's stock had caused serious difficulty to plaintiff in depasturing his horses, and in keeping them in good condition for the winter. „ The trespasses had extended over a period of several months, and . defendant's stock had been repeatedly turned off the land, and notice of action had been ineffectually served upon Mr. Green. The weather continues oppressively hot, all herbage around town looks as withered as in the middle of summer, our river has seldom been seen running Ies3 water, and at present the prospect for the coming winter is a gloomy one. The township has, however, borne an aspect of temporary liveliness for the last few davs, owing to many teams loaded with storekeepers* sundries arriving together. Travelling sheep oontinue to pass through Tumut, and several flocks belonging to Mr. Still and Mr. Stinson camped on our reserves last week, A Chinaman living at the Gilmoro was brought before our Bench on Tuesday last, charged with maliciously wounding a bullock the property of Robert Wilson, poundkeeper ; but there being no. evidence to sustain the aocusation the man was discharged.
