The claim was for dr(8ang 70,000 feet of timber at 2s. per 100, and*the defence set up was that only 41,000 feefinad been 'delivered and tho agreement cancelled by consent. The defendant howovor admitted that more .timber might have been .drawn to tho creek, as he had not been on tho spat since he sold tho wholo of his codar, winch was at tho timo the 41,000 feet was delivered.
