PIANO PLAYING IN A FLAT In the Chancery Division yesterday the action lor alleged nuisance brought against Mr Emerson AVhit horne, composer and pianist, of Syd neyTtemice, South Kensington, was dismissed with costs (reports the ' pally :Kcws" of November 20). The plaiiUms were Mr Arthur Bioxham <ind Sir Percy Malton, defendant's landlords, and Mr Charles William Daly, a dentist, who occupies a floor immediately underneath Jlr AVhit horno's flat, and the complaint made was ol excessive piano-plaving and j the monotonous repetition of tunes. Jlr AVhithorne denied the allegations, j Mr Justice Neville lield that in pre- | mises of this kind there must be some j give and. take. Having no evidence! from £;ny person in sound health of : being unnoyed by,the music, he found that no nuisance had been established.1
