The plaintiff's counsol opened tho oase by describing tlio articl.os of agreement, relative to the sain in November 1872, by defendants (who were executors of. the late- G. Synnot) to the firm of Molosworth and Ware, of Cowl Cowl station; Ono section of tho agree ment specified that a log fenco six miles in length should be removed by ddfondants as soon as possible. This fence had not been romoved to the present-time, thus depriving tlio plaintiff of 6000 acres, and access to water. A serious loss had boon incurred bv tho plaintiff— hence the present action.
