MIGUEL YENDO ct. al. appellants vs. JESSE WHEELER et ul. appellees From Victoria Mr. Justice Wheeler delivered the opinion of the Court. The plaintiffs brought their notion of trespass to try title to a league of land. They claimed as heirs of ManuePYendo and his wifa Cns- iana Zambrauo under a title issued by the Commissioner of De Leon's colony iu r1833. The defendants claimed under a purchase made at a sale of the laud for taxes in 1850. The plaintiffs gave in evidence tho grant to Zambrauo and proved that they were the heirs of the .grantee and that her husband Manuel Yeudo died in 1828 or 1829. Tho defendants introduced as evidence of titles in themselves the deed of the assessor and collector of the county bearing date on the 22d day of August 1850 made iu pursuance of a sale for the taxes for the year 1810.
