A Peculiar (Diise of nmpomirting. A puzzling case came before the Full Court the other day. It appearod that a man named Tully, who owned some land near Grafton, took some horses, which were tres passing, to the Grafton pound. This was on Sunday, and ho therefore merely obtained from Gunthorpe, the poundkeeper, the key of the pound nnd locked the horses up for safe custody until Monday morning. The owner, feeling aggrieved, instructed his attorney to proceed against both parties, and Gunth'irpe was brought up on a penal information, whilo Tully was treated to a civil process ; and though the charges made wer,o distinct in their nature, and under different sections of the Municipalities Act, tho cases were tried together, and the de fendants fined. They appeal for a prohibition to set the proceedings aside and were success ful.
