The plaintiff proved that he sold the defendant a   load of wood, for which. he was to receive £1. In answer to the defendant, he admitted that at the time the baagain was made for the wood a contract was entered into for 100 saplings, which had not yet been delivered. Defendant contended that as the contract was not yet filfilled, plaintif could not claim the money.
