CLAIM BY BUILDER On Monday, at the Footscray Court. A. M. Nelson proceeded against R. H. Wallace for''the re covery of p£l5/l5/4. Mr Brocket', for complainant, said it was a building contract case NeUon had agreed to build defend ant a house for a certain sum, and Wallace was now holding back pait'oi the money. Mr Secomb, for the defence, said Wallace had a long list of com plaints. . Complainant gave evidence. Mr Secomb—How far do the stumps go in the ground ? Complainant—I could not say. Is the picture moulding finished? -Yes. Ha* the lining in the bathroom been finished ? —To the best of my knowledge. > Other evidence haying been: given, Charles Armstrong was: called for the defence. He stated; that he inspected the house on the 28th, and found the average depth of- the stumps to be from six to nine inches, while the' specifica tions stipulated 12 inches. The picture moulding was not properly .finished. - ■ The Bench made an order for the amount claimed, with £3/3/ costs.
