IS THE LAW A HASS? [Newspaper Article] — The Mount Barker Courier and Onkaparinga and Gumeracha Advertiser — 1 April 1927

IS THE LAW A HASS? Sain Weller was wont to say. "The law is a hass," and a case which was heard in the Local Court, Murray Bridge ou Wednesday somewhat justi fies the statement. In this case de pendent was summoned to appear at the court and auly attended accom panied by counsel. So soon as the case was called on defendant's counsel challenged the jurisdiction of the court, cited numerous decisions, and his point was upheld by the court. Tuen counsel applied for costs on be half of bis client, hut the court, while sympathizing with defendant, said there was no power to grant costs seeing that the court had no jurisdic tion. Thus a person can be duly summoned to a court (and failure to attend may-result in a verdict against him), ana having been placed to heavy expense, cannot obtain costs to reim burse him for what is no fault of his own.
