Sloan, J.P., a case was called on where Jas. Scwell asked the bench to make an order compelling James Righetti to pay his share of the cost of erecting a new fence dividing their properties. Mr U. L. Lazarus, of Cluncs, ap peared for the complainant, and Mr D. Clarke, of Ballarat, on behalf of Righetti. Both parties are well kr.oivn Smea tou landowners. When the case was called on Mr Clarke raised an objection on behalf of his client to Mr Sloan sitting on the bench, it being contended that with the police magistrate on the bench the decision would be more satisfactory.
