A peremptory writ of mandamus directing the present state board of education to carry out the contracts entered Into between the 1912 board and Wheeler & Co., together with six other book companies, was granted by District Judge John J. Carney. In deciding the case Judge Carney held that the 1912 board had exercised discretionary powers and that having awarded the contracts to the book companies the duty was Incumbent upon the present board to carry out the contracts, and thut In bo doing their duty was purely ministerial.
