The indictment sets forth' that he was secretary of war on ^ June 16,1873/at which itime certain proceedings Jvere pending in relation to the appointment and retention in office of the trader at Fort Sill, and that he re ceived the sum of $1,000 from Calpli P. Marsh with interest to have his decision and action on the question pending influence and appointed ''¦ John S. Evans as post trader 111 consideration of having received; said sum.
