Charles Kinghorn, a constable deposed that hclwas in the ha- bit of driu king at Cash's grog shop in Liverpool-street. He was the only evidence on the part iif the Crown, and maileout a'clear case of retailing, halbe admitted that he expected a part ot the penalty, although Mr. Capon was the »»former. A lilli» before 6 o'clockion the morn- ing of the previous day Mr. lliddlcstone had gone out, leaving his shopman Mr. Dowsett as a protection, though indisposed and in bed in the room adjoining the shop, with which it communicates by,a glas3 door. Having locked the outer door he threw the key, accord- ing to custom, underneath, about two feet into the shop. The prisoner, it appeared, musthave been aware j of this transaction and having extracted the key, un- locked the door & entered the room with the freedom and manner usually practiced by Mr. Hiddlestoue him- self. CRIMINAL COURT, HOBART TOWN, DECEMBER 30, 1826.   This being the day appointed for passing sentence on the criminals in Gaol, fifteen of those convicted of capital offences were led into Court. His Honor the Chief Justice first proceeded to decide the case of the three sheep-stealers, Robert Grant, George Bentley,   and William Crest. An objection had been urged by the Counsel for the prisoners wherein it was endea- voured to shew that the evidence produced upon the   trial had not been sufficient for conviction The Judge   had very fully and maturely considered the force of this objection, which he overruled, the instance pro- duced in support of it not applying to that of the pri- soners.
