VACCINATION AND ITS OPPONENTS. [Newspaper Article] — North Melbourne Courier and West Melbourne Advertiser — 5 June 1896

VACCINATION AND ITS 'OP PONENTS: RECENTLY, in the:Supreme Couit, Mr. F. J. Sixcoca made an application to Mr. Juetice Hoxqx to review a dcision of thoi'Prahran Bench, fining a defen dant on a second charge for not having his child vaccinated. Mr. SIncoca's contention was that there could only ac tually be one transgression of the vacci nation law. He urged that it was by no means a continuing offence, and that if a person was fined for not having his child vaccinated,,and paid the fine,-or was distrained on, or went to gaol, that person had paid the penalty, and could not be proceeded against for a sccond offence, iil respect of the same charge. Mr. Justice HonoES ruled tlhat there could be no second conviction in those t; 'ul tall-presecitionsereto fore launched, and all convictions subse quent thereon were, in effect, ultria vires. The anti-vaccination-paerty--have-thus scored a:point-and a strong one too. As regards the medical arganient whethervaccination is desirableoor not it ...
